The purpose of this addition to administrative rule TRN-10.03 is:
1. To clearly state the expectation of continuous permitting.
A permit is required for work in the public right of way, or for the closure of the public right of way to facilitate work on private property. A valid permit must be maintained throughout the duration of the impact to the right of way.
2. To clearly state the consequences of a lapse in continuous permitting.
When a valid temporary street use permit is not maintained, the occupation of the right of way is in violation of TRN-10.03 and is subject to enforcement under the Right-of-Way Use Enforcement administrative rules (TRN-8.14).
• Time spent in violation of TRN-10.03 is subject to retroactive permit fees, using the current temporary street use fee schedule, calculated from the day the occupation of the right of way became a violation.
• Time spent in violation of TRN-10.03 may be subject to additional penalties beyond retroactive permit fees, stated in TRN-8.14.
